FUNNELS MASTERY ACADEMY

This Terms of Service and User Agreement (hereinafter referred to as the “Agreement”) constitutes a legally binding contract between Funnels Mastery Academy (hereinafter referred to as the “Provider”, “Company”, “we”, or “us”) and the individual enrolling in the program (hereinafter referred to as the “Participant”, “User”, or “you”).

By accessing the website www.funnelsmasteryacademy.com, purchasing the Course, or accessing any associated materials, you expressly acknowledge that you have read, understood, and agreed to be bound by the terms and conditions contained herein, as well as our Privacy Policy, in accordance with the Data Privacy Act of 2012 (R.A. 10173).

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY CEASE USE OF THE PLATFORM AND SERVICES.

ARTICLE 1: ENROLLMENT, ELIGIBILITY, AND VERIFICATION

1.1 Legal Capacity

By enrolling, the Participant warrants that they are at least eighteen (18) years of age and possess the legal capacity to enter into contracts under Philippine Law. Participants under the age of 18 must provide a notarized letter of consent from a parent or legal guardian to be eligible for enrollment.

1.2 Truthfulness of Information

To ensure the security and integrity of the community, the Participant agrees to provide accurate, current, and complete information during registration. The use of pseudonyms, aliases, fabricated identities, or temporary/disposable email addresses is strictly prohibited. The Provider reserves the right to immediately terminate any account found to be in violation of this provision without notice or refund, effectively treating the enrollment as void ab initio.

ARTICLE 2: SCOPE OF LICENSE AND ACCESS DURATION

2.1 Grant of License

Subject to the terms of this Agreement and the full payment of applicable fees, the Provider grants the Participant a limited, non-exclusive, non-transferable, and revocable license to access and use the Course materials for personal, non-commercial educational purposes.

2.2 Access Duration and Batch Distinctions

The duration of the license granted herein depends strictly on the Participant’s enrollment batch:

A. Current and Future Batches (Batch 7 and succeeding cohorts):

The Participant is granted access to the Course Portal and Community Platform for a fixed period of TWELVE (12)

MONTHS commencing on the date of enrollment.

B. Legacy Batches (Batches 1 through 6):
Participants in these specific cohorts retain Lifetime Access to the Course Portal content. However, access to the Community Platform (including live coaching and interactive features) is limited to the original one (1) year term, unless renewed.

2.3 Renewal of License

Upon the expiration of the twelve (12) month period, the license to access the Course and Community shall automatically terminate. The Participant may elect to renew their license subject to the payment of a renewal fee and the terms prevailing at the time of renewal.

ARTICLE 3: FINANCIAL TERMS, INSTALLMENTS, AND REFUNDS

3.1 Consideration and Pricing

The standard enrollment fee is Philippine Pesos: Forty Thousand (PHP 40,000.00). The Provider reserves the right to offer promotional pricing (e.g., Early Bird rates) at its sole discretion. The fee agreed upon at the point of sale is final. The Participant expressly waives any right to claim a refund or adjustment based on subsequent price reductions or promotions offered to other individuals.

3.2 Installment Guidelines and The "Access Clock"

For Participants electing the Installment Plan:

A. Obligation to Pay: The Participant acknowledges that the installment plan is a binding financial obligation for the full contract price established at enrollment.

B. Commencement of Term (The "Access Clock"): The twelve (12) month access period commences strictly on the date of the FIRST installment payment.

C. Effect of Suspension: In the event of payment default, access to the Course shall be suspended. The twelve (12) month access term shall continue to run during the period of suspension. The Provider shall not be liable to extend the access period to compensate for time lost due to the Participant’s non-payment.

3.3 Default and Revocation

Failure to settle an outstanding installment within fourteen (14) calendar days of the due date constitutes a material breach of this Agreement. The Provider reserves the right to permanently revoke the license and terminate access.

3.4 Refund Policy

In compliance with the Consumer Act of the Philippines (R.A. 7394) and given the nature of digital goods:

A. General Rule: All payments are FINAL and NON-REFUNDABLE. The "No Return, No Exchange" prohibition under R.A. 7394 applies to defective goods; it does not mandate refunds for "change of mind" regarding non-defective digital content.

B. Limited Exception (Cooling-Off Period): A refund may be granted SOLELY if: The request is made within seven (7) calendar days of purchase; AND The Provider’s system logs verify that the Participant has NOT accessed, viewed, streamed, or downloaded any portion of the Course materials.

C. Administrative Deduction: In the event a refund is approved under the Limited Exception, a non-refundable Administrative and Processing Fee of One Thousand Five Hundred Pesos (PHP 1,500.00), plus any applicable bank or gateway transfer fees, shall be deducted from the refund amount.

D. Timeline: Approved refunds shall be processed within fourteen (14) to thirty (30) business days.

3.5 Invalid Grounds for Refund

The Provider shall not entertain refund requests based on:

1. Personal reasons (e.g., "too busy," "lack of time," "change of priorities");

2. Non-usage of the Service; or

3. Failure to achieve specific financial results.

4.1 Proprietary Rights

All content provided by the Provider, including but not limited to videos, frameworks, templates, strategies, and text, is the exclusive intellectual property of Funnels Mastery Academy and is protected by the Intellectual Property Code of the Philippines (R.A. 8293).

4.2 Prohibited Commercial Use (Non-Compete)

The Participant agrees that the materials are for personal education and application in their own business or client work. The Participant SHALL NOT:

1. Repackage, reproduce, or resell the Course content.

2. Create, launch, or market a competing educational product, course, mentorship program, or similar service that teaches Funnel Design or Funnel Strategy utilizing the Provider’s proprietary methodologies, naming conventions, or frameworks.

4.3 Community Code of Conduct

To maintain the integrity of the community, the Participant agrees to:

1. Engage in respectful professional communication.

2. Refrain from spamming, self-promotion, or soliciting other members for their own services.

3. Avoid disruptive, offensive, or unethical behavior.
Violation of this section is grounds for immediate termination.

4.4 Enforcement

A violation of Section 4.1 or 4.2 shall be deemed a willful infringement of intellectual property rights. The Provider reserves the right to pursue civil and criminal actions under Philippine law, including claims for damages and attorney’s fees.

ARTICLE 5: OPERATIONAL GUIDELINES

5.1 Office Hours

Support services are available from 8:00 AM to 5:00 PM (Philippine Standard Time), Mondays through Fridays, excluding Philippine Legal Holidays. Inquiries received outside these hours will be addressed on the next business day.

5.2 Live Sessions and Replays

If the Course curriculum includes live sessions, attendance is encouraged but not mandatory. The Provider will upload replays of these sessions to the portal for the Participant's convenience. Inability to attend live sessions does not constitute grounds for a refund.

5.3 Modifications

The Provider reserves the right to modify the Course curriculum, platform, or content at any time to ensure relevance. Such modifications shall not constitute a breach of contract nor entitle the Participant to a refund.

ARTICLE 6: DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

6.1 No Guarantee of Results

The Provider makes no representations or warranties regarding specific financial outcomes, revenue, or business success. The Participant acknowledges that results vary based on individual effort, market conditions, and business acumen. The Provider fulfills its obligation by providing the educational content; the application of such content is the sole responsibility of the Participant.

6.2 Limitation of Liability

To the fullest extent permitted by law, the Provider shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Course. The Provider’s total liability shall not exceed the amount actually paid by the Participant.

ARTICLE 7: TERMINATION

The Provider may terminate this Agreement and revoke access immediately, without notice or refund, upon the occurrence of any of the following:

1. Non-payment of fees;

2. Discovery of false identity, fabricated registration details, or disposable email addresses;

3. Violation of Intellectual Property rights or Non-Compete clauses; or

4. Breach of Community Guidelines.

ARTICLE 8: GOVERNING LAW AND VENUE

This Agreement shall be governed by and construed in accordance with the laws of the Republic of the Philippines. In the event of any dispute arising out of or in relation to this Agreement, the parties agree to submit to the exclusive jurisdiction of the competent courts of Metro Manila, to the exclusion of all other courts.

ACKNOWLEDGMENT

BY COMPLETING THE ENROLLMENT PROCESS, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.
